General terms and conditions of service

The conditions described here apply to all visa processing requests, for tourist trips or of any other kind that are processed at the request of the client before the relevant consular authorities. The client declares that he/she is aware of, understands and accepts the rights and obligations.

1. Applications

The client who applies for a visa must provide all the documentation required according to the conditions and requirements established by the consular authorities of the destination country so that the application can be processed correctly within the established deadlines.

Gestiona Visa will endeavour to provide you with accurate information and ensure that you obtain the visa for your trip on the required date and on time. However, although we do our best to provide accurate information, passport and travel visa requirements are constantly changing and there may be a delay before we are informed of such changes. Therefore, we cannot always guarantee absolute accuracy. The processing times and charges indicated are for information purposes only and cannot be guaranteed.

You should also bear in mind that all visa requirements (documentation, fees, deadlines, etc.) are calculated on the basis of general criteria, which may vary depending on the information provided by you, such as current or previous nationality, place of residence, sex, age, profession, recent trip, religion, etc. Likewise, the consular authority may change country requirements without prior notice or require additional information and/or documentation specific to you. Gestiona Visa will try to inform you as soon as possible of such changes.

Where the “no” need for a visa or information on travel visas upon arrival in the destination country is indicated, we always recommend confirming this information with the airline and the embassy or high commission before travelling. Travel arrangements should not be confirmed before the issuance of the passport or visa, unless this is required by the consulate. In such cases, airline tickets that allow changes and/or refunds are recommended.

Gestiona Visa recommends obtaining travel visas as far in advance as possible before travelling.

Our online application process allows you to review and correct errors before sending us your application. Once your application has been submitted, you will receive an email from us to confirm that we have received your order. After receiving the necessary documents, we will notify you that we have received your documents and have begun processing your visa application..

2. Cancellation

As a consumer, you have the right to withdraw from the service requested through our website within a period of 14 days from the date you made your request. However, this withdrawal period will be interrupted if, during this period, the documentation provided by the client is received at our office for the start of the contracted services. The client is aware of this circumstance and expressly accepts it. After receiving the documentation and the start of the entrusted procedures, no amount paid for the payment of consular fees, our fees or any other expense arising from the procedures entrusted to Gestiona Visa by the client will be refundable. However, the amounts received as fees will not be subject to any refund in the event that the requested procedure does not finally take place at the request of the applicant.

To proceed at any time with the withdrawal or cancellation of the contracted service, the client must send Gestiona Visa a withdrawal notice by email to formalize it.

Pursuant to the provisions of LAW 47/2002, of December 19, reforming Law 7/1996, of January 15, on the Regulation of Retail Trade, for the transposition into Spanish law of Directive 97/7/EC, regarding distance contracts, and for the adaptation of the Law to various Community Directives, returns or cancellations of the following products will not be accepted: “Products made to consumer specifications or clearly personalized, specifically assembled according to a design specified in a configuration, or which, by their nature, cannot be returned or may deteriorate or expire quickly.”

Article 45 of this Law establishes the Exceptions to the right of withdrawal. Therefore, the withdrawal of a procedure already started will not be accepted under the following heading of article 45: “Contracts for the supply of goods made according to the consumer's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire quickly.”

In cases where customers request the cancellation of the charge made to their bank, when the cancellation of the request and/or withdrawal of the purchase is not applicable, according to the Terms and Conditions accepted when making the request, the customer will be obliged to the seller, to compensate for the damages caused, according to Article 46 of Law 47/2002, of December 19, reforming Law 7/1996, of January 15: "... if the purchase had actually been made by the cardholder and the request for a refund was not a consequence of having exercised the right of withdrawal or termination recognized in article 44 and, therefore, having improperly demanded the cancellation of the corresponding charge, the former will be obliged to compensate the seller for the damages caused as a consequence of said cancellation."

3. Delays

Likewise, Gestiona Visa will not be liable for any type of delay as a result of delays in the delivery of the requested documentation caused by failures or incidents in the collection or delivery attributable to the courier company contracted for this purpose.

The issuance of a visa depends exclusively on the issuing authority and the immigration officials of each country have the final decision to admit entry into the country even if the visas have been issued. Gestiona Visa cannot give any guarantee that the competent authority will issue the visa in a timely manner and therefore, Gestiona Visa's fees will be charged for carrying out the necessary procedures for such issuance. Non-refundable tickets or reservations should not be purchased until all visas are secured. It is advisable to consult directly with the consulate or embassy of each country regarding all applicable visa requirements. In any case, the visa applicant (and not Gestiona Visa) will be responsible for ensuring that all visa requirements have been met.

Gestiona Visa will not be held responsible for any delay in the issuance of visas by the authority issuing them, for the criteria for granting them, if applicable, or for the denial of a requested visa. Decisions on deadlines, requirements or for their issuance or denial are the exclusive responsibility of the consulate of the corresponding country.

We advise our clients to apply for visas as early as possible and not to purchase airline tickets until we have confirmed that the visa has been issued by the consular authorities.

4. Rates

Prices indicated in writing or by telephone are estimates until the requested service is fully completed.

Gestiona Visa reserves the right to modify its rates in the following cases:

• Incomplete application or application not in accordance with the type of visa requested

• Change in consular fee rates without prior notice.

• Changes in processing times that involve paying an additional fee to our rates or to the consular fees for processing the visa in less than three days and/or 24 hours, as the case may be.

Payment for the contracted services must be made in full at the start of the process by deposit into a bank account, bank transfer, payment with any accepted credit or debit card or cash at our office.

It is the responsibility and obligation of the person requesting the visa to make the payment at the beginning of the process as provided herein. Gestiona Visa reserves the right to suspend or not carry out any application received until payment has been made and is exempt from all liability in the event of any damages that this may cause to the applicant.

5. Returns and deliveries

The client must send the documents necessary to carry out the contracted service by his own means and under his own responsibility. All expenses incurred will be the sole responsibility of the client. Gestiona Visa will reject any type of shipment received with postage due, in any case, unless previously agreed.

Likewise, any type of sending or returning documentation due to it not being correct will be the responsibility of the client, and will be sent postage due in all cases.

The sending of the documents, once the consular authority has issued the visa, will be carried out on the same day that they are received by the consulate, and delivery will be made to the address indicated by the client and this will be done before 7 pm on the following business day by the courier company agreed upon in accordance with the delivery conditions stipulated by said company. The cost of the shipment will in all cases be borne by the client unless otherwise agreed between the client and Gestiona Visa.

The collection time at the Gestiona Visa office of passports with processed visas or other documents is from the day after confirmation by us, within our business hours or before the stipulated deadline in case of urgency.

Once Gestiona Visa returns your passport and documents, it is important that you confirm that you have received all the visas you need for your trip, that the visas for each of the countries you are going to visit are valid for the arrival and departure dates of the country or region of your visit, as well as for the purpose and nature of your visit (tourism, business, studies, etc.). If there is any discrepancy in your documentation, you must immediately notify Gestiona Visa by email.

Any type of delay or incident in the subsequent return of the passports to their holders, once they have been delivered to the courier company for delivery, will be the sole responsibility of the courier company according to the conditions established in its transport conditions. Gestiona Visa will be free of all responsibility.

6. Processing times

Gestiona Visa undertakes to act with the utmost diligence and to submit the documentation as quickly as possible after receiving it at its office.

The processing period is counted from the day after the visa documentation is delivered to our office until the day of collection of the passport with the visa included and is calculated on working days.

Gestiona Visa declines all responsibility for any visa application not executed or with a significant delay in its processing as a result of the lack of documentation or not being correctly delivered in form or date and in any case for any eventual failure, delay or negligence of the consular authorities in issuing the visa.

The issuing consular authority will have the final decision regarding the type of visa or legalization, the speed of its issuance and the validity with which it will be issued. Before proceeding to approval, the consular authority may request additional documentation. The issuing authority may refuse any visa, passport or other travel document for any reason and may not provide Gestiona Visa with any reason for refusal. Gestiona Visa does not issue visas or passports and we cannot give any guarantee or assurance that the document will be issued by an issuing authority.

Gestiona Visa also cannot guarantee the time required for an issuing authority to grant or refuse an application. Consular authorities may choose to grant a different travel document than the one the applicant has requested, which may affect the purpose, validity or number of entries. As a result, non-refundable tickets or reservations should not be purchased until all necessary travel documents are secured. Gestiona Visa reserves the right to prioritize processing based on the travel dates you provide. Gestiona Visa service fee charges will be applied according to the timeframes appropriate to the completion of the issuance of visas requested prior to the travel dates.

Gestiona Visa will, whenever possible, endeavour to process the client's visa, passport and/or document based on the instructions given and application forms submitted, although it is the client's responsibility to ensure that the visa/passport/document obtained is valid and covers the time periods necessary for the client's plans to enter and leave the country or countries to be visited, as well as the number of entries into the country and that it is valid for the intended purpose.

7. Limitation of liability

Gestiona Visa shall only be liable if, through negligent action or error on its part, a passport or document is lost, misplaced, damaged, delayed or destroyed, and its liability shall be limited to the cost of the basic replacement of said document. Gestiona Visa shall not be liable for items lost, damaged, delayed or destroyed by a courier service or a consular authority. Passport covers and all original documents or certificates that Gestiona Visa does not request for presentation shall remain in the possession of the applicant. Gestiona Visa accepts no liability for the loss or damage of said documents. Gestiona Visa does not accept any responsibility for travellers who choose to obtain their visas on arrival and these are not granted or are denied entry into the country for any reason.

Gestiona Visa will not be responsible for any damage or economic loss caused to the client, if for any reason arising from the processing of visas, these are not granted or their issuance is delayed by the issuing authority, preventing travel on the dates initially planned or causing penalties, re-issuance of tickets or expenses for cancellations of reservations or contracted holidays.

8. Information processing

In accordance with the provisions of the Organic Law on the Protection of Personal Data, we inform you that the information you provide will be kept in a file. This file will be the responsibility of Gestiona Visa, visas y legalizaciones, S.L, a commercial company with registered office at c/ López de Hoyos 78 duplicado, Bajo A, 28002 Madrid and CIF number B09608795 that provides visa management services and billing for said services. You authorize us to keep your data for the purposes described above, even after our relationship has ended. We inform you that you may exercise your right to access, modify, withdraw or oppose said data by requesting it in writing to Gestiona Visa, visas y legalizaciones, S.L, c/ López de Hoyos 78 duplicado, Bajo A, 28002 Madrid

If you have provided us with personal data of a third party or do so in the future, you must inform said third party and ask for consent to do so, exempting Gestiona Visa, tramite de visados ​​S.L from any liability.

Gestiona Visa undertakes not to disclose to third parties the information and data provided by our clients.

The collection and automated processing of Personal Data is intended to maintain the contractual relationship established with Gestiona Visa, the management, administration, provision, expansion and improvement of the services that the client requests from Gestiona Visa, registering, or using the adaptation of said services to the preferences and tastes of the Users, the study of the use of the services by the client, the analysis ... of Users, the design of new services related to said services, the sending of service updates, the sending, by traditional and electronic means, of technical, operational and commercial information about products and services offered by Gestiona Visa, currently and in the future. The purpose of the automated collection and processing of Personal Data also includes the sending of survey forms, which the User is not obliged to answer.

Gestiona Visa respects all the rights and guarantees of the Spanish LOPD, guaranteeing the confidentiality of all personal data provided by the client. These data will only be used by its internal services for the processing and management of the requested visas and to channel information, in particular, through information letters, e-mails and SMS, as well as within the framework of the personalization of the site based on the user's stated preferences.

The visa processing service provided by Gestiona Visa may involve the communication of your data to the Foreign Diplomatic Mission of the corresponding country, which may involve International Movement of Data.

By accepting the provision of the Gestiona Visa service, you give your express consent to said international movement.

Gestiona Visa does not sell, market or rent information relating to its clients to third parties.

Gestiona Visa will provide the logistics operator with the information necessary for the documentation to reach its recipients or to be collected for processing.

9. Accuracy and truthfulness of the data provided

The registered User is solely responsible for the truthfulness and correctness of the data included, exonerating Gestiona Visa from any liability in this regard.

Users guarantee and respond, in any case, for the accuracy, validity and authenticity of the personal data provided.

10. Modification of the general conditions of service

Gestiona Visa reserves the right to modify the general conditions of sale without prior notice, being able to change, delete or add both the contents and services provided through its Web page as well as the way in which these appear presented or located on its servers.

These changes must be accepted by the User each time he requests any of our services. In the event that any of the terms of the general conditions is illegal or unenforceable, it will be null and void and the agreement between the parties will apply, and in the absence of such, the provisions of the Spanish Civil Code.

11. Jurisdiction

The Courts of Madrid are the only competent courts. These general conditions of sale will be interpreted in the Spanish language and will be carried out in accordance with Spanish law. Any disagreement that may arise regarding its validity, interpretation or execution will be submitted to the Courts of Madrid, to which exclusive jurisdiction is expressly attributed.
